Ebonyi State Government- Invitation To Bid For Disposal/Lease Of Land Spaces And Building In Abuja, Abia And Imo States

EBONYI STATE GOVERNMENT
INVITATION TO BID FOR DISPOSAL/LEASE OF LAND SPACES AND BUILDING IN ABUJA, ABIA AND IMO STATES

(1) WHEREAS Ebonyi State Government during an enlarged Stakeholders/ Public Participation Meeting on 29^th day of October, 2021, and pursuant to Section 62 of Ebonyi State Public Procurement and Related Matters Law, 2020 and Section 23 of Ebonyi State Public Private Partnership Law, 2021 secured approval from Ebonyi stakeholders and NGOs etc. to dispose/lease some fixed assets of Ebonyi State Government.

(2) WHEREAS Ebonyi State House of Assembly in exercise of its power and in its proceedings dated 9^th Day of November, 2021 granted approval for the State Government to dispose/lease the said fixed assets.

(3) WHEREAS Ebonyi State Executive Council had on 30^th November, 2021 approved competitive open bidding processes for the disposal and or lease of the fixed assets to be carried out by the Bureau of Public Procurement adopting the Public Private Partnership method; and

(4) WHEREAS Ebonyi State Government had on 9^th December, 2021 Issued public service announcement through newspaper adverts in National Dallies and Local Tabloids informing members of the public of its Intention to dispose/lease the State Government assets herein-before listed and requesting those who have valid objections to this proposal to approach Ebonyi State House of Assembly to either cancel the approval given or set aside the Public Private Partnership Law of the State and other laws of the State dealing on this matter, and whereas the Seven (7) clear days given for such objection elapsed on the 17^th day of December, 2021 and no one raised any objection or adverse opinion on the proposal.

(5) NOW THEREFORE, Ebonyi State Government offers the following categories of assets (Category A and B) for Lease/Sale:

(6) CATEGORY A

(a) Investors under CATEGORY A (Mode of Alienation will be PPP) shall pay non- refundable deposits as stated below to Ebonyi State Internally Generated Revenue (IGR) Account Number 1016884688 in UBA Bank.

(b) BID SECURITY
Bid Security as listed above will be submitted and SHALL be valid for 6 months after the Agreement is signed and site handed over to the successful selected bidder provided there is an investment on ground of up to 20% before the 6 months expiration, otherwise it is assumed that the Bid Security will be rolled over automatically for another 6 months until 20% investment on ground is achieved.

(c) Note that during Bid evaluation, 50% discount for all Ebonyi Indigenes with a proof of ownership of investment of up to 60% and above will be given.

(d) LIMIT OF INVESTMENT WITHIN TWO YEARS
Investment in category A within two (2) years of receipt of letter of approval for the successful bidder, SHALL not be less than Two Billion Naira (N2,000.000,000.00).

(e) LIMIT OF INVESTMENT WITHIN 3 YEARS
A bidder’s total investment within three years is expected to be completed and running and total investment must not be less than the sums as shown in Table 1 above.

(7) CATEGORY B
(a) NON-REFUNDABLE DEPOSIT
An investor under CATEGORY B (Mode of Alienation is sale) shall pay a non- refundable deposit as stated below into Ebonyi State Internally Generated Revenue (IGR) Account No 1016884688 in UBA Bank.

(b) BID SECURITY
Bid Security as listed above will be submitted and SHALL be valid for 6 months after the Agreement is signed and site handed over to the successful selected bidder provided there is an investment on ground of up to 20% before the 6 months expiration, otherwise it is assumed that the Bid Security will be rolled over automatically for another 6 months until 20% to investment on ground is achieved.

(c) Note that during Bid evaluation, 50% discount for all Ebonyi Indigenes with a proof of ownership of investment of up to 60% and above will be given.

(8) Interested members of the public are given between 19 January, 2022 to 21 February, 2022 to inspect any or all of the said facilities (in categories A and B) to enable them bid.

(9)TAKE FURTHER NOTICE that the mode of investment in CATEGORY A is to build, operate and transfer (BOT) to Ebonyi State Government within Sixty (60) years and to pay Ebonyi State Government 5% of Annual Gross Earnings for 57 years with 2 years grace period after Project Construction of three years maximum. The apartments that may be occupied by the investor, shall be evaluated for Ebonyi State Government to earn an income as if apartment is to be rented out.

(10) Ebonyi State Government is not bound to accept the lowest bidder or any bid.

(11) Bids submission shall end on 21 February, 2022 at 1:00pm and bid opening will commence immediately same day by 1:00pm.

(12) Bidders will come physically with their bidding documents on 21 February 2021 by 1:00pm to Old Exco Chambers, Abakaliki.

(13) Development of the asset shall last for a maximum of three (3) years while moratorium which shall be for Five years, including the 3 years construction period and 2 years grace period before payment commences.
