INVITATION TO TENDER FOR THE EXECUTION OF 2023 CAPITAL & ZONAL INTERVENTION PROJECTS
(1) INTRODUCTION
The National Biotechnology Development Agency (NABDA) intends to apply the funds allocated to her in 2023 Appropriation Act for the execution of some capital projects/programme and Zonal Intervention Projects under her statutory mandate.
(2) SCOPE OF WORK
Accordingly, the Agency invites interested, reputable, and competent contractors to tender for the participation in the procurement of Goods, Works, and Services as listed below:

(3) ELIGIBILITY CRITERIA
Qualified, interested and eligible contractors must submit Technical tender bid document supported with the following:-
(a) Evidence of Certificate of Incorporation with Corporate Affairs Commission (CAC including forms CAC2 and CAC7. Business Name with Form BN1 is also acceptable for Services;
(b) Evidence of Company’s Income Tax Clearance Certificate (or Personal Income tax Clearance Certificates of all the Partners In case of Business Name) for the last three (3) years (2020, 2021 & 2022) valid till 31st December 2023
(c) Evidence of Pension Compliance Certificate valid till 31st December, 2023 (this requirement is only applicable to bidders whose number of staff is 15 and above);
(d) Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31st December 2023 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is N50m and above).
(e) Evidence of Nigeria Social Insurance Trust Fund (NSITF) Compliance Certificate valid till 31st December 2023.
(f) Evidence of registration on the National Database of Federal Contractors, Consultants and Service Providers by Submission of Interim Registration Report (IRR) expiring on 31st December 2023 issued by BPP.
(g) An Affidavit:
(i) disclosing whether any officer of the relevant committee of the National Biotechnology Development Agency (NABDA) or the Bureau of Public Procurement (BPP) is a former or present Director, shareholder, or has any pecuniary interest in the bidder and to confirm that all the information presented in its bid are true in all particulars.
(ii) That no director has been convicted in any Country for any criminal offence relating to fraud or financial impropriety or criminal misrepresentation or falsification of facts relating to any matter
(iii) That the company is not in receivership, the subject of any form of insolvency or bankruptcy proceedings or the subject or any form of winding up petition or proceedings.
(iv) That the company does not have existing loan or financial liability with a bank other financial institution or third party that is classified as doubtful non-performance, bad or whose repayment portion has been outstanding for the last four (4) months.
(h) Company’s Audited Accounts for the last three (3) years (2020, 2021 & 2022);
(i) Reference Letter from a reputable Commercial Bank indicating willingness to provide credit facility for the execution of the project when needed.
(j) Company’s Profile with the Curriculum Vitae of Key Staff to be deployed for the project, inducing copies of their Academic/Professional qualification such as COREN, QSRBN, ARCON, CORBON etc.
(k) Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including Letter of Award Valuation Certificates, Job Completion Certificate and Photographs of the Projects.
(l) Works: List of Plant/Equipment with proof of Ownership/Lease Agreement
(m) For Supply of Equipment Letter of Authorisation as representative of the Original Equipment Manufacturer (OEMs).
(n) Consultancy of Services: Evidence of Firm’s registration with relevant regulatory professional body(ies) such as NITDA & CPN, CMD, COREN, QSRBN, ARCON, CORBON etc.
(o) Electricity Jobs: Evidence of current Licence issued by Nigerian Electricity Management Service Agency (NEMSA)
(p) For Joint Venture/Partnership, Memorandum of Understanding (MoU) should be provided (CAC, Tax Clearance Certificate, Pension Clearance Certificate, ITF Compliance Certificate, NSITF Clearance Certificate, IRR & Affidavit are compulsory for each JV partner) NOTE: NOT MORE THAN TWO COMPANIES SHOULD FORM A JOINT VENTURE
(q) All documents for submission must be transmitted with a Covering/Forwarding Letter under the Company/Firm’s Letter Head Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC, Contact Address, Telephone Number (Preferably GSM No), and e-mail address. The Letterhead Paper must bear the Names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorized officer of the firm.
(4) SPECIAL INSTRUCTION
Where applicable, prospective bidders must procure hardware devices such as Laptops and Desktops only from National Information Technology Development Agency (NITDA) Certified Original Equipment Manufacturer (OEM).
(5) SUBMISSION OF EXPRESSION OF INTEREST FOR CATEGORY C
Interested Consultant shall submit one original and photocopy of their expression in a sealed envelope clearly stating the name of the project, lot number addressed to Director General, National Biotechnology Development Agency Umar Musa Yar’Adua Express Way, Lugbe, Abuja, FCT, not later than 12:00noon Wednesday, 14 June 2023. The name of the Company should be written on the reverse side of the envelope.
(6) COLLECTION OF TENDER DOCUMENTS CATEGORY A AND B
Interested bidders are to collect the Standard Bidding Document from the office of the Procurement Unit, National Biotechnology Development Agency, Umar Musa Yar’Adua Expressway, Lugbe—Abuja, FCT on the evidence of payment of a non-refundable fee of N10,000.00 per Lot, paid into National Biotechnology Development Agency’s Remita account in any reputable Commercial Bank with GlFMIS Code: 0228008001. Tender Receipt must dearly state the Lot Number, Title of the Project and the Name of the Company purchasing the bid Tender Receipt must be presented to the Procurement Unit for the collection of the bid document.
(6) SUBMISSION OF TENDER DOCUMENTS CATEGORY A AND B
(a) Bid must be in English and signed by an official authorised by the bidder.
(b) Prospective bidders are to submit bid for each of the Lot desired, two (2) hard copies each of the technical and financial bids packaged separately in sealed envelopes and clearly marked as ‘’Technical Bid”. Thereafter, put the two sealed envelopes together in a bigger sealed envelope addressed to Director General, National Biotechnology Development Agency Umar Musa Ya’Adua Express Way, Lugbe Abuja, FCT.
(c) Combining Technical and Financial Bid in the same Envelope will lead to automatic Disqualification.
(d) Each Bid Package should be clearly marked with the following on both sides of the envelope.
(e) Technical Bid marked NABDA/SBD/LOT XXX/TECHNICAL/2023 at the top right-hand corner for Category A and B while NABDA/LOT XXX/EOI/2023 for Category C
(f) Financial Bid NABDA/SBD/LOT XXXX/FINANCIAL/2023 at the top right-hand corner, (Please note that XXX Denotes the Lot Number) for Category A and B.
(g) Furthermore, the reverse of each sealed envelope should bear the name, email, phone number address of the bidder.
(h) All copies of the bids shall be duly signed by an authorised representative of the Bidder. In the event of any discrepancies between copies, the original shall govern.
(i) Interested party shall not bid for more than two (2) lots of all 2023 NABDA projects.
(j) NABDA will assume no responsibility for the content of tamper evident bids or for non-compliance with this instruction. Bids that do not comply shall be disqualified.
(k) Kindly note that submissions shall be subjected to verification from relevant authorities. The Deadline for Submission is 12:00 noon Monday 10 July 2023.
(7) OPENING OF EOI AND TECHNICAL BIDS
Kindly note that EOI for Category C will be opened immediately after the deadline for submission at 12:00 noon Wednesday, 14 June, 2023.
Kindly note that only technical bids for category A and B will be opened immediately after the deadline for submission at 12:00pm on Monday, 10 July 2023.
(i) For Category A and B – All bids must be submitted at the 1st floor Conference Room of National Biotechnology Development Agency, Umar Musa Yar’Adua Express Way Lugbe – Abuja, FCT.
(ii) For Category C – All EOls must be submitted at the 1st floor Conference Room of National Biotechnology Development Agency, Umar Musa Yar’Adua Express Way Lugbe – Abuja, FCT.
(iii) All Contractors with the presence of two (2) representatives of private sector professional bodies and Civil Society Organization in the areas of Anti-Corruption and Transparency invited to witness the opening exercise.
(8) ADDITIONAL INFORMATION
(i) All expenses incurred in the preparation and submission of any response to this invitation shall be borne solely by the interested and participating company.
(ii) Submission of bids through email or fax will not be accepted.
(iii) Category A-B: Only qualified bidders at technical evaluation will be invited at a later date for financial bids opening, while the financial bids of un-successful bidders will be returned unopened;
(iv) Category C: Only shortlisted firms will be invited at a later date for collection of Request for Proposals;
(vii) This advertisement shall not be construed to be a commitment on the part of NABDA nor shall It entitle the bidding companies to any claim whatsoever and/or seek indemnity from NABDA by virtue of such company having responded to the advertisement;
(viii) The NABDA is not bound to pre-qualify/shortlist any bidder and reserves the right to annul the Procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act, 2007.
