INVITATION TO TENDER FOR 2023 CAPITAL PROJECTS

(1.0) INTRODUCTION
The Nigerian Communications Satellite, in compliance with the provisions of the Public Procurement Acts, 2007, intends to undertake the execution of the under listed projects under the 2023 Capital Budget of the Agency. To this end, Interested, Experienced and Competent Contractors/Service Providers are invited to tender for the execution of the projects:

(4.0)  ELIGIBILITY REQUIREMENTS:
Interested, experienced and competent contractors should submit the following eligibility documents indicating the minimum qualification required of a bidder. All bids must be accompanied with the following:

(i) Evidence of Certificate of Incorporation issued by the Corporate Affairs Commission (CAC), including form CAC1.1 or CAC2 and CAC7. Business Name with Form BN 1 is also acceptable for Services;

(ii) Evidence of Company’s Income Tax Clearance Certificate (or Personal Income Tax Clearance Certificate of all the Partners in case of Business Name) for the last three (3) years valid till 31st December, 2023;

(a) Evidence of Pension Clearance Certificate valid till 31st December, 2023 (this requirement is only applicable to bidders whose number of staff is 15 and above);

(b) Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31st December, 2023 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is N50m and above);

(c) Evidence of Nigeria Social Insurance Trust Fund (NSITF) Clearance Certificate valid till 31st December, 2023;

(d) Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31/12/2023 or valid Certificate issued by BPP.

(e) Sworn Affidavit:

• disclosing whether or not any officer of the relevant committees of the Nigerian Communications Satellite, Limited or the Bureau of Public Procurement is a former or present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
• that no Director has been convicted in any Country for any criminal offence relating to fraud or financial impropriety or criminal misrepresentation or falsification of facts relating to any matter;
• that the Company is not in receivership, the subject of any form of insolvency or bankruptcy proceedings or the subject of any form of winding up petition or proceedings;

(f) Company’s Audited Accounts for the last three (3) years -2020, 2021 & 2022;

(g) Reference Letter from a reputable Commercial Bank in Nigeria, indicating willingness to provide credit facility for the execution of the project when needed;

(h) Company’s Profile with the Curriculum Vitae of Key Staff to be deployed for the project, including copies of their Academic/Professional qualifications such as COREN, QSRBN, ARCON, CORBON etc.;

(i) Verifiable documentary evidence of at least three (3) similar jobs (in size, nature & complexity) executed in the last five (5) years including Letters of Awards, Valuation Certificates, Job Completion Certificates and Photographs of the projects;

(j) List of Plants/Equipment with proof of Ownership/Lease Agreement;

(k) Lot 1B & 4B: Evidence of Firm’s current accreditation issued by the Centre for Management Development (CMD)

(l) IT Jobs: Evidence of firm’s current accreditation/registration with the National Information Technology Development Agency (NITDA) and Computer Professionals Registration Council of Nigeria;

(m) Only Companies in the National Automotive Design and Development Council’s approved list of local manufacturers of vehicles or their authorized representatives should bid for vehicle;

(n) For Joint Venture/Partnership, Memorandum of Understanding (MoU) should be provided (CAC, Tax Clearance Certificate, Pension Clearance Certificate, ITF Compliance Certificate, NSITF Clearance Certificate, IRR & Sworn Affidavit are compulsory for each JV partner)

(o) All documents for submission must be transmitted with a Covering/ Forwarding letter under the Company/Firm’s Letter Head Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM No.), and e-mail address. The Letterhead Paper must bear the Names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorised officer of the firm.

(5.0) COLLECTION OF TENDER DOCUMENTS (CATEGORY A)
Interested Companies are to collect the Standard Bidding Document from Procurement Department, 3rd floor NIGCOMSAT Limited, Abuja on presentation of a copy of original receipts of non-refundable Tender fees of N10,000.00 (Ten Thousand Naira Only) per Lot paid into NIGCOMSAT LTD Remita account in any reputable Commercial Bank in Nigeria.

(6.0) SUBMISSION OF TENDER DOCUMENTS (CATEGORY A)
Bidders are to submit for each of the desired lot, two (2) hard copies each of the technical and Financial Bids, with soft copy of the financial bid only in MS Excel format packaged separately in two sealed envelopes and marked “TECHNICAL BID FOR LOT….” or “FINANCIAL BID FOR LOT….” at the top left-hand corner of each envelope with the Company name indicated at the back of each envelope. Both envelopes should be sealed and placed in a third or bigger envelope marked with the Lot number at top right corner and address to:

(7.0) SUBMISSION OF EXPRESSION OF INTEREST (EOI) DOCUMENTS CATEGORY B:
Interested firms are to submit two (2) bound of expression of interest (EOI) documents separated by dividers and arranged as indicated above. The documents should be submitted in a sealed envelope and addressed as indicated above and clearly marked with the name of the project and the Lot number. Furthermore, the reverse of each sealed envelope should bear the name and address of the bidder and drop in the designated Tender Box not later than 11:00 am Tuesday, 11 July, 2023.

(8.0) OPENING OF TECHNICAL BIDS AND EOI DOCUMENTS
The EOI and Technical bids will be opened immediately after the deadline for submission as follows:

at NIGCOMSAT Ltd Auditorium.

Please ensure that you sign EOI/Bid Submission Register at the Procurement Department, is NIGCOMSAT Ltd, will not be held liable for misplaced or wrongly submitted bids.

(9.0) GENERAL INFORMATION
(i) EOIs/Bids must be in English language and signed by an official authorised by the bidder.

(ii) EOIs/Bid submitted after the deadline for submission would be returned unopened.

(iii) Late submission will be returned un-opened.

(iv) Bidders should not bid for more than one (1) lot

(v) All cost will be borne by the bidders.

(vi) All documents submitted will be subjected to verification from the relevant agencies.

(vii) Bid documents can also be collected in soft copies and Bidders can submit through Post (Courier Services).

(viii) CATEGORY A: Only pre-qualified bidders at technical evaluation will be invited at a later date for financial bids opening, while the financial bids of unsuccessful bidders will be returned un-opened.

(ix) CATEGORY B: Only shortlisted firms will be invited at a later date for collection of Request for Proposal.

(x) This advertisement shall not be construed as a commitment on the part of NIGCOMSAT Limited to enter into any form of contract with any company nor shall it entitle responding bidders to seek any indemnity from NIGCOMSAT Limited by virtue of such bidder having responded to the advertisement.

(xi) The law of Nigeria including the Constitution of the Federal Republic of Nigeria shall be applicable in all legal issues relating hereto.

(xii) All financial bids should be quoted in Naira (N) for all Nigerian companies, while foreign-based companies should avail themselves with the most current (prevailing) exchange rate.

(xiii) The Nigerian Communication Satellite Limited is not bound to pre-qualify/shortlist any bidder and reserves the right to annul the procurement process at any time without incurring any liability in accordance with section 28 of the public Procurement Act, 2007.

(10) CONFIDENTIALITY
All documents will be treated with the strictest terms of confidentiality.
