INVITATION TO TENDER FOR SUPPLY OF GOODS, WORKS AND NON-CONSULTANCY SERVICES FOR THE SECRETARIATS, DEPARTMENTS AND AGENCIES (SDA) OF THE FEDERAL CAPITAL TERRITORY ADMINISTRATION (FCTA) UNDER THE FCT 2024 STATUTORY APPROPRIATION ACT

1. INTRODUCTION
The Federal Capital Territory Administration (FCTA) has provisions in the financial year (FY) 2024 FCT Statutory Appropriation Act for Supply of Goods, Works and Non-Consultancy Services for the Secretariats, Departments and Agencies (SDAs).
Accordingly, in line with the Public Procurement Act, 2007 competent and interested Companies are hereby invited to submit Technical and Financial bids for Goods, Works and Non-Consultancy Services. The Projects and Tender Identification Number (TIN) are as follows:

2. SCOPE OF GOODS/WORKS/SERVICES

3. ELIGIBILITY REQUIREMENTS
All Interested companies are to submit copies of the following documents and the following documents and the original to be made available for sighting during due diligence exercise.
a. Evidence of certificate of incorporation issued by the Corporate Affairs Commission (CAC) including, form CAC 1.1 or CAC 2 and CAC 7.
b. Evidence of Company’s Income Tax Clearance Certificate for the last three (3) years (2021, 2022, 2023) valid till 31st December 2024;
c. Evidence of Pension Clearance Certificate valid till 31st December 2024 (this requirement is only applicable to bidders whose number of staff is 15 and above);
d. Evidence of Industrial Training Fund (ITF) compliance certificate valid till 31st December 2024 (this requirement is only applicable to bidder whose number of staff is 5 and above or bidder’s annual turnover is N50m and above);
e. Evidence of Nigeria Social Insurance Trust Fund (NSITF) Clearance Certificate valid till 31st December 2024;
f. Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31st December 2024; or valid certificate issued by BPP;
g. Sworn affidavit disclosing whether or not any officer of the relevant committees of the Federal Capital Territory Administration or the Bureau of Public Procurement is a former of present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bids are true and correct in all particulars;
h. Company’s Audited Accounts for the last three (3) years 2021, 2022, 2023
i. Reference Letter from a reputable commercial bank in Nigeria, indicating willingness to provide credit facility for the execution of the project when needed;
j. Company’s Profile indicating its activities, with the Curriculum Vitae of Key Staff to be deployed for the project, including copies of their Academic/Professional qualifications such as COREN, QSRBN, ARCON, CORBON , EHORECON, ESVARBON, NMDPRA, etc.;
k. Verifiable documentary evidence of at least (3) similar jobs executed in the last five (5) years including Letters of Awards, Valuation Certificates, Job Completion Certificates and Photographs of the projects;
l. For Supply of Equipment: Letter of Authorization as representative of the Original Equipment Manufacturer (OEMs)
m. For Motor Vehicle’s Procurement: Only companies included in the National Automotive Design and Development Council’s approved list of local manufacturers of vehicles or their authorized representatives should bid for the Vehicles;
n. List of Plants/Equipment with proof of Ownership/Lease Agreement;
o. For joint venture/partnership, memorandum of understanding should be provided (CAC, Tax Clearance Certificate, Pension clearance certificate, ITF compliance Certificate, NSITF Clearance certificate, IRR and sworn affidavit are compulsory for each JV partner)
Note: All documents for submission must be transmitted with a Covering/Forwarding letter under the Company/Firm’s Letter Head Paper bearing amongst others the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM No.) and e-mail address. The Letterhead Paper must bear the Names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorized officer of the firm.

4. SPECIFIC ADDITIONAL REQUIREMENTS FOR PRE-QUALIFICATION
a. Bidders for Electrical Works/Services shall provide evidence of current license issued by Nigerian Electricity Management Services Agency (NEMSA) and shall have a minimum average turnover of N10,000,000.00 for three (3) years;
b. Bidders for Solid Waste Collection and Management Services and Facility Management Services must be registered with Environmental Council of Nigeria (EHOCON) in the appropriate category of the services to be provided, shall provide evidence of valid practicing license expiring 31st December 2024.
c. Bidders for Solid Waste Collection and Management Services shall have a minimum average turnover of N70,000,000.00 for three (3) years.
d. In addition, bidders for Solid Waste Collection and Management Services must provide proof of ownership of the following Plants/Equipment (in the number required for each project) which must be accomplished with evidence of ownership such as Receipt, Licenses and Permit issued by FCT DRTS or states (where applicable). The Receipt, Licenses and Permits must be in name of the bidders (if owned) or Lessor (if leased).
e. In case of Leasing of the above-mentioned Plant/Equipment, for Solid Waste Collection and Management Services, Bidders shall lease from a reputable Lessor or Lease Vendor with known address/location where the Equipment will be inspected and shall also provide a written agreement for unconditional release of the Plants/Equipment when needed by AEPB/FCTA.
f. Bidder for Solid Waste Collection and Management Services must have an operational office in Abuja.
g. Prospective bidders for Supply of Vehicles shall possess a minimum average turnover of N1,000,000,000.00 for three (3) years accompanied with evidence of Manufacturer’s Authorization from Original Equipment Manufacturer (OEM). Only Companied included in the National Automotive Design and Development Council’s approved list of local manufacturer of vehicles, or their authorized representatives should bid for the Vehicles.
h. Bidders for the Supply of Petroleum Product shall provide Evidence of up-to-date Registration with NMDPRA for Petroleum Products and shall have a minimum average turnover of N100,000,000.00 for three (3) years;
i. Bidders for the Supply Water Treatment Chemicals shall provide Evidence of up-to-date Registration with National agency for Food and Drug Administration and Control (NAFDAC) and shall have a minimum average turnover of N500,000,000.00 for three (3) years;
j. Interested bidders for ICT Related Projects shall provide evidence of current Registration/accreditation with Computer Professional Registration Council of Nigeria, Evidence of Manufacturer’s Authorization from Original Equipment Manufacturer (OEM) and NITDA registration and
k. Interested bidders for Printing related Projects shall provide evidence of current Registration with Chartered Institute of Professional Printers of Nigeria (CIPPON).

5. COLLECTION OF TENDER DOCUMENTS
Interested companies are to collect the Standard Bidding Document (SBD) for the respective projects of interest as in Schedule of Collection; Submission; Venue and Opening Date Table on evidence of payment of a non-refundable tender fee of N10,000.00 per Lot, paid into the FCT Treasury Single Account (TSA) e-collection project powered by Remita.

a. Access the e-collection platform via www.remita.net
b. Click on “pay TSA & States”
c. Click on FEDERAL CAPITAL TERRITORY ADMINISTRATION
d. Click on “who do you want to pay “ and enter “FCTA PROCUREMENT DEPARTMENT”
e. Click on “Name of services/purpose” to display a drop-down list of services types provided by the SDA and select your choice.

f. Enter other payment details as required and click “SUBMIT” to generate Remita Retrieval Reference (RRR).
g. Select any preferred electronic payment channel (Card, Internet Banking, USSD, Wallet, Phone Number or select Bank Branch to walk to any closet bank branch of your choice to complete your payment.) payer will be issued an electronic receipt following payment, which you can take to the specific SDA to receive the applicable services.

6. SUBMISSION OF TENDER DOCUMENTS (GOODS & WORKS)
Prospective bidders are to submit bids for each of the Lot desired, two (2) hard copies of the technical and financial bids with softcopy of financial bids only in MS Excel format, packaged separately in sealed envelopes and clearly marked as “Technical Bid” or “Financial Bid”. Therefore, put the two sealed envelope together in a bigger sealed envelope addressed as in the Schedule of Collection; Submission; Venue and Opening Date table and clearly marked with the name of the project and the Lot No. Furthermore, the reverse of each envelope should bear the name and address of the bidder and drop in designated Tender box as in the Schedule of Collection; Submission; Venue and Opening Date Table.

6.1. SCHEDULE OF COLLECTION; SUBMISSION; VENUE AND OPENING AND OPENING

 7. GENERAL INFORMATION
a. Bids must be in English language and signed by an official authorized by the bidder;
b. Bids submitted after the deadline for submission would be returned un-opened;
c. All cost will be borne by the bidder;
d. This advertisement to tender shall not be construed to be commitment on the part of the FCT Administration and its SDAs nor shall it entitle the bidder to make any claim whatsoever and seek any indemnity from the FCT Administration and its SDAs by virtue of having responded to the advertisement.
e. Successful companies may be requested to provide Performance Guarantee/Bond, whose value shall not be less than 10% of the Contract Sum before signing the contract;
f. A bid security is form of bank Guarantee from a reputable Nigerian Bank and whose value is 2% of the tender sum shall be submitted with tender sum of N100 Million and above for GOODS/CONSULTANCY/NON-CONSULTANCY SERVICES and N300 Million and above for WORKS in the format as approved in the Standard Bidding Document;
g. The Technical Bids will be opened in the presence of Bidders or their representatives, CSOs in the areas of Anti-Corruption and Transparency and Private Professional bodies;
h. Only pre-qualified bidders at technical evaluation will be invited at a later date for financial bids opening and the financial bids of un-successful bidders will be returned un-opened.
i. The FCTA is not bound to pre-qualify any bidder and reserves the right to annual the Procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act, 2007.
