EXPRESSION OF INTEREST (EOI) AND NON-CONSULTANCY SERVICES FOR FY2025 CAPITAL PROJECTS (PHASE II) ADDENDUM

THIS ADVERT OUGHT TO HAVE BEEN PUBLISHED ON MONDAY, SEPTEMBER 15, 2025, BUT DELAYED TILL TODAY (TUESDAY, SEPTEMBER 16, 2025), DUE TO PRODUCTION MIX-UP.

1.0 INTRODUCTION
1.1 The Benin-Owena River Basin Development Authority (BORBDA), hereinafter referred to as “the Authority”), a Parastatal of the Federal Ministry of Water Resources and Sanitation, is desirous of executing her FY2025 Capital Projects. In compliance with the Public Procurement Act, 2007, the Authority hereby invites interested, experienced and competent Contractors/Consultants to submit bids for the implementation of the following projects:

2.0 SCOPE OF SERVICES
The Scope of Services are categorised and packaged into Lots as shown in the table below:

3.0 ELIGIBILITY REQUIREMENTS
a. Evidence of Certificate of Incorporation issued by Corporate Affairs Commission (CAC) including Form CAC1.1 or CAC2 and CAC7. Business Name with Form BN1 is also acceptable for Services;
b. Evidence of Company’s Income Tax Clearance Certificate (or Personal Income Tax Clearance Certificates of all Partners in case of Business Name) for the last three (3) years (2022, 2023 & 2024) valid till 31st December, 2025;
c. Evidence of Pension Clearance Certificate valid till 31st December, 2025 (this requirement is only applicable to bidders whose number of staff is 15 and above);
d. Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31st December, 2025;
e. Evidence of Nigeria Social Insurance Trust Fund (NSITF) Clearance Certificate valid till 31st December, 2025;
f. Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31st December, 2025 or valid Certificate issued by BPP;
g. Sworn Affidavit disclosing whether or not any officer of the relevant committees of the Benin-Owena River Basin Development Authority or the Bureau of Public Procurement is a former or present Director, Shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
h. Company’s Audited Accounts for the last three (3) years – 2022, 2023 & 2024;
i. Reference Letter from a reputable Commercial Bank in Nigeria, indicating willingness to provide credit facility for the execution of the project when needed;
j. Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including Letters of Awards, Valuation/Job Completion Certificates and Photographs of the projects;
k. Lot A22: Evidence of current registration with the Office of the Auditor-General for the Federation and
l. Company’s Profile with the Curriculum Vitae of Key Staff to be deployed for the project, including copies of their Academic/Professional qualifications such as ANAN, ICAN etc
m. Lot E2: Evidence of Firm’s current License issued by the Nigeria Security and Civil Defence Corps (NSCDC);
n. For Joint Venture/Partnership, Memorandum of Understanding (MoU) should be provided (CAC, Tax Clearance Certificate, Pension Clearance Certificate, ITF Compliance Certificate, NSITF Clearance Certificate, IRR & Sworn Affidavit are compulsory for each JV partner)
Note: All documents for submission must be transmitted with a Covering/Forwarding letter duly signed by the authorised officer of the Firm. The Company/Firm’s Letter Head Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM No.), and e-mail address. The Letterhead Paper must bear the Names and Nationalities of the Directors of the Company at the bottom of the page.

4.0 COLLECTION OF TENDER DOCUMENTS (CATEGORY E)
Interested Companies are to collect the Standard Bidding Document (SBD) from the Office of the Head of Procurement Unit, Room 067, Ground Floor, Benin-Owena River Basin Development Authority, Km 24, Benin/Sapele Road, Obayantor on presentation of evidence of payment of a non-refundable tender fee of N10,000.00 per Lot, paid into the Benin-Owena River Basin Development Authority’s Remita account in any reputable Commercial Bank in Nigeria, and bidders are to generate Remita Retrieval Reference (RRR) and pay into the BORBDA Remita e-collection IGR Account Number 025203800100 and the GIFMIS code for the Tender fees is 1000020623.

5.0 SUBMISSION OF EXPRESSION OF INTEREST:
5.1 For Expression of Interest (EoI), interested firms should submit two (2) bound copies of EoI documents duly signed, paginated, separated by dividers and arranged in the order outlined in 3.0 above. The documents should be submitted in a sealed envelope and addressed to the Managing Director, Benin-Owena River Basin Development Authority, Km 24, Benin/Sapele Road, Obayantor, P.M.B.1381, Benin City. The reverse side of each sealed envelope should bear the name and address of the bidder and dropped in the designated Tender Box at the New Conference Room, Benin-Owena River Basin Development Authority, Km 24, Benin/Sapele Road, Obayantor not later than 12:00 noon, Tuesday, 30th September, 2025.
5.2 CATEGORY E : Prospective bidders for Invitation to Tender for Non-Consultancy Services are to submit two (2) hard copies each for technical and financial bids with softcopy of the financial bid only in MS-Excel format; packaged separately in sealed envelopes and marked as “Technical Bid” or “Financial Bid”. Thereafter, put the two sealed envelopes together in a bigger sealed envelope addressed to the Managing Director, Benin-Owena River Basin Development Authority, Km 24, Benin/Sapele Road, Obayantor, P.M.B.1381, Benin City, and clearly marked with the name of the project and the Lot number at the top right corner. Furthermore, the reverse side of each sealed envelope should bear the name and address of the bidder and dropped in the designated Tender Box at the New Conference Room, Benin-Owena River Basin Development Authority, Km 24, Benin/Sapele Road, Obayantor not later than 12:00 noon, Tuesday, 30th September, 2025.

6.0 OPENING OF EOI AND TECHNICAL BIDS
6.1 Only the Technical Proposal for the Expression of Interest (EoI) and Invitation to Tender for Non-Consultancy Services will be opened immediately after the deadlines for submission at 12:00 noon Tuesday, 30th September, 2025 in the New Conference Room, Benin-Owena River Basin Development Authority, Km 24, Benin/Sapele Road, Obayantor, Benin City in the presence of bidders or their representatives. Please ensure that you sign the EOI/Bid Submission Register in the office of the Head, Procurement Unit, Ground Floor, Room 067, BORBDA Headquarters Complex, Km 24, Benin/Sapele Road, Obayantor, Benin City, as the Benin-Owena River Basin Development Authority will not be held liable for misplaced or wrongly submitted EoIs/bids. 7.0 GENERAL INFORMATION
a. EOIs/Bids must be in English Language and signed by an official authorised by the bidder;
b. The authorised official shall be introduced to the Authority by a Letter of Authority duly signed by the Director or Secretary of the Company;
c. EOIs/Bids submitted after the deadline for submission would be returned un-opened;
d. All costs will be borne by the bidders;
e. For Category E: Only pre-qualified bidders at technical evaluation will be invited at a later date for financial bids opening, while the financial bids of unsuccessful bidders will be returned unopened;
f. For Category A: Only shortlisted firms will be invited at a later date for collection of Request for Proposals;
g. The EOIs and Technical Bids will be opened in the presence of Bidders or their representatives, CSOs in the areas of Anti-Corruption and Transparency and Private Professional bodies;
h. Bid documents can also be collected in soft copies and Bidders can submit through post (Courier Services). Bids submitted through post must be received before the deadline for submission of bids, otherwise the bid will be returned un-opened;

The Benin-Owena River Basin Development Authority is not bound to pre-qualify/shortlist any Applicant and reserves the right to annul the Procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act, 2007.
