INVITATION TO TENDER/EXPRESSION OF INTEREST

1.0 INTRODUCTION
1.1 The Energy Commission of Nigeria (ECN) is the Government organ with the statutory mandate for the Strategic planning and coordination of National Policies in the field of Energy in all its ramifications, and to ensure adequate, reliable, cost-effective and sustainable energy supply for nation’s economic and socio-political development. In compliance with the Public Procurement Act 2007, the Commission wishes to undertake the procurement of works/services under the 2019 capital projects.

1.2 Experience and competent contractors/consultants are invited to apply for the Technical and financial bids under category A and submit Expression of Interest (EOI) under category B of the various projects of the Commission for the 2019 fiscal year.

2.0 SCOPE OF WORKS/SERVICES

3.0 ELIGIBILITY REQUIREMENT
The following requirements for Tender shall be submitted:
(a) Evidence of Certificate of Incorporation with the Corporate Affairs Commission (CAC) including Form CAC2 and CAC7;
(b) Evidence of Company Income’s Tax Clearance Certificate for the last three (3) years (2016, 2017 & 2018) valid till 31st December, 2019
( c) Evidence of current Pension Compliance Certificate valid till 31st December, 2019;
( d) Evidence of current Industrial Training Fund (ITF) Compliance Certificate valid till 31st December, 2019;
( e) Evidence of current Nigeria Social Insurance Trust Fund (NSITF) Compliance Certificate valid till 31 December, 2019;
( f) Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31/1/2020 or valid Certificate issued by BPP.
( g) Sworn Affidavit disclosing whether or not any officer of the relevant committees of the Energy Commission of Nigeria (ECN) or the Bureau of Public Procurement is a former or present Director, shareholder or has any pecuniary interest in the bidder, that the company is not bankrupt, in receivership or under liquidation or involved in any litigation which can potentially affect the company’s ability to effectively discharge their responsibility if engaged and to confirm that all information presented in its bid are true and correct in all particulars;
( h) Company’s Audited Accounts for the last three (3)years – (2016,2017 & 2018);
(i) Company Profile with Curriculum Vitae of Key Staff to be deployed tor the project, including copies of their Academic /Professional qualifications; eg COREN, QSRBN, CORBON etc.
(j) Evidence of financial capability to execute the project by submission of Reference Letter from a reputable commercial bank indicating willingness to provide credit facility for the execution of the project when needed;
(k) Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including letters of Awards, Valuation Certificates, Job Completion Certificates and Photographs of the projects;
(l) Evidence of Registration of Individual/Company with relevant Professional Bodies for the applicant of Category B
(m) For Joint Venture/Partnership, Memorandum of Understanding (MoU) should be provided (Tax Clearance Certificate, Pension Compliance Certificate, ITF Compliance Certificate, NSITF Compliance Certificate, IRR & Sworn Affidavit are compulsory for each JV partner)
(n) All documents for submission must be transmitted with a Covering/Forwarding letter under the Company/Firm’s Letter Head Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM No.), and e-mail address. The Letterhead Paper must bear the Names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorized officer of the firm.

4.0 COLLECTION OF TENDER DOCUMENTS – CATEGORY A
Interested companies are to collect the Standard Bidding Document (SBD) from the office of the Secretary, Public Procurement Unit, Ground floor, Room 0.011, Energy Commission of Nigeria on evidence of payment of a non- refundable fee of N10.000.00 per Lot, paid into the Energy Commission of Nigeria’s Remita account in any commercial bank. Prospective bidders tor Category B are not expected to pay at this stage except when shortlisted for Request for Proposals (RFP)

5.0 SUBMISSION OF TENDER DOCUMENTS – CATEGORY A
Prospective bidders are to submit bid for each of the Lot desired, two (2) hard copies each of the technical and financial bids with softcopy of financial bid only in MS Excel format, packaged separately in sealed envelopes and dearly marked as “Technical Bid” or “Financial Bid”. Thereafter, put the two sealed envelopes together in a bigger sealed envelope addressed to:
The Director-General/CEO Energy Commission of Nigeria Plot 701C, Central Business District P.M.B.358, Garki, and clearly marked with (the name of the project and the Lot number). Furthermore, the reverse of each sealed envelope should have the name and .address of the bidder and drop in the designated Tender Box at the reception in the premises of the Energy Commission’s office in Abuja not later than 12:00 Noon Tuesday 15 October, 2019.

6.0 OPENING OF BID – Category A
The technical bids will be opened immediately after the deadline for submission 12:00Noon Tuesday, 15 October, 2019. at the premises of Energy Commission of Nigeria, Abuja in the presence of bidders or their representatives, while the Financial bids will be kept un-opened. Please, ensure that you sign the Bid Submission Register in the office of the head of Public Procurement Unit, Room-011, at ground floor of the Commission headquarters. No. 701C, Central Area Abuja as the Energy Commission of Nigeria will not be held liable for misplaced or wrongly submitted bids. 7.0 SUBMISSION OF EoI DOCUMENTS – Category B
Interested firms are to submit two (2) bound of Expression of Interest (Eol) documents separated by dividers and arranged as indicated above. The documents should be submitted in a sealed envelope and addressed to:

8.0 OPENING OF EOI DOCUMENTS – CATEGORY B
The EOl documents will be opened immediately after the deadline for submission 12:00 Noon Tuesday 17 September, 2019 at the premises of Energy Commission of Nigeria, Abuja in the presence of bidders or their representatives. Please, ensure that you sign the Bid Submission Register in the office of head of Public Procurement Unit, Room-0.011, at ground floor of the Commission headquarters, N0.701C, Central Area Abuja, as the Energy Commission of Nigeria will not be held liable for misplaced or wrongly submitted bids. 9.0 GENERAL INFORMATION
(a) Bids/EoI must be in English Language and signed by an official authorized by the bidder;
(b) Bids/Eol submitted after the deadline would be returned un-opened.
( c) Only Companies with Technical Bids that fulfill the requirements would have their names pasted on the Commission’s website and notice board: and their financial bids will be publicly opened on a date to be indicated on the same notice.
( d) All bids are expected to include ORIGINAL COPIES of the receipt of Tender fee in their financial bid envelopes.
( e) Companies and Bidders shall not apply for more than Two (2) Lots
( f) Unsigned Bid by authorised officer of the Company would be rejected.
( g) Submission of bidding document is not a guarantee for the award of contract.
( h) All submissions would be verified from the relevant Agencies like Federal Inland Revenue (FIRS), BPP etc.
(i) This publication does not constitute an offer, nor does it constitute a commitment or obligation on the part of the Commission.
(j) All costs will be home by the bidders.
(k) The Energy Commission of Nigeria is not bound to select any bidder and reserves the right to annul the Procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act 2007.
