INVITATION TO TENDER FOR THE EXECUTION 2010 CAPITAL PROJECTS

1.0 INTRODUCTION
The Federal Government of Nigeria has allocated Funds to the Federal Ministry of Health in the Year 2019 Appropriation. The Ministry intends to use this allocation and Funds from other sources for the procurement of Goods, Works and Services for the execution of Policies, Programmes and Projects towards achieving its mandate. Accordingly, the Federal Ministry of Health invites qualified, interested and eligible vendors; suppliers; contractors; Original Equipment Manufacturers (OEMs) and consultants to tender for the procurement of Goods, Works and Services appropriated under the various Departments of the Ministry in the Year 2019 Appropriation as specified in the following paragraphs.

2.0 CATEGORIES OF PROJECTS

CATEGORY A: GOODS (FOR TECHNICAL AND FINANCIAL BIDS)

3.0 ELIGIBILITY REQUIREMENTS
In order to be considered, interested bidders shall present the following documents in their technical tender;
(a) Evidence of Certificate of Incorporation with the Corporate Affairs Commission (CAC) including Forms CAC2 and CAC7;
(b) Evidence of current Pension Compliance Certificate valid till 31st December, 2019.
( c) Evidence of Company Income’s Tax Clearance Certificate for the last three years (2016,2017 & 2018) valid till 3151 December, 2019;
(d) Certificate of Compliance with Industrial Training Fund (ITF) valid till 31st December, 2019;
( e) Certificate of Compliance from Nigeria Social Insurance Trust Fund (NSITF) valid till 31st December, 2019;
( f) Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 1/1/2020 or valid Certificate issued by the BPP;
( g) Evidence of financial capacity to execute the project by submission of Reference Letter from reputable Commercial Bank indicating willingness to provide credit facility for the execution of the project when needed;
(h) Documentary evidence of at least three (3) similar jobs executed in the last five (5) years including Letters of Awards, Valuation Certificate, Job Completion Certificates and Photographs of projects;
(i) Company’s Audited Accounts for the last three (3) years: 2016, 2017 and 2018;
(j) Lots A1 & A2: Letter of Authorization from the Original Equipment Manufacturers listed in the Approved Policy for Procurement of Health and Medical Equipment for Tertiary Hospitals in Nigeria;
(k) Sworn affidavit:
(a) that firm is not bankrupt;
(b) that none of the Director is an ex-convict or bankrupt;
(c) disclosing whether or not any officer of the relevant committees of the Federal Ministry of Health or the Bureau of Public Procurement is former or present Director, shareholder or has any pecuniary interest in its bid, that all information presented in its bids are true and correct in all particulars;
(l) Company’s profile with Curriculum Vitae of Key Staff to be deployed for the project by submission of copies of their Academic/Professional qualifications;
(m) Consultancy Service: Evidence of Firm’s registration with the relevant professional bodies;
( n) Lot A4: Only companies included in the National Automotive Design and Development Council’s approved list of local manufacturers of vehicles or their authorised representatives should bid for the vehicles;
( o) List of Plants/Equipment with proof of ownership/lease (where applicable).
( p) All documents for submission must be transmitted with a Covering/Forwarding letter under the Company/Firm’s letterhead paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM No.) and e-mail Address. The Letterhead Paper must bear the Names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorised officer of the Firm.

4.0 COLLECTION OF TENDER DOCUMENTS
Interested companies are to collect the Standard Bidding Document (SBD) from the office of the (state the position of the person, room and floor number and the office address) on evidence of payment of a non-refundable tender fee of N10,000.00 per Lot, paid into the (state the MDA’s name) ‘s Remita account in any reputable commercial bank in Nigeria.

5.0 COLLECTION OF TENDER DOCUMENTS
Interested bidders shall collect Standard Bidding Document from the Office of the Chief Procurement Officers at Rooms 302/306 3rd Floor, Federal Ministry of Health Headquarters, Federal Secretariat Complex during working hours upon presentation of evidence of payment of the Tender fee. Other document (s) to support the qualification and tender documents are as may be contained in the Standard Bidding Documents. A non- refundable tender fee of Ten Thousand Naira (N10,000.00) Only per Lot is payable by all bidders into the Federal Ministry of Health’s Treasury Single Account (TSA). The Procurement Department may be consulted for further clarification. Also, interested firms in Consultancy Service will not collect bid documents at this stage until after short-listing.

6.0 SUBMISSION OF TENDER DOCUMENTS (CATEGORY A & B)
Prospective bidders are to submit: (A) Two (2) hard copies each of the technical and financial bids. (B) Soft Copy of the financial bid for each of the Lot desired, packaged separately in two sealed envelopes. Each of the envelopes must be clearly marked either as “Technical Bid” or “Financial Bid”. Thereafter, put the two sealed envelopes together in a bigger sealed envelope addressed to the Permanent Secretary, Federal Ministry of Health and clearly marked with (the name of the project and the Lot No.). Furthermore, the reverse of all the sealed envelopes must bear the name and address of the bidder, project title and Lot Number and dropped in the designated Tender Box not later than 12:00 noon on Monday 13, January, 2020 at:

7.0 SUBMISSION OF PRE-QUALIFICATION/EXPRESSION OF INTEREST
Prospective bidders are to submit pre-qualification documents/EOI for each of the Lot, desired; two (2) hard copies each of the technical bids/EOI packaged in sealed envelopes and clearly marked as “Technical Bid” or “EOI”; and addressed to the Permanent Secretary, Federal Ministry of Health and clearly marked with (the name of the project and the Lot No.). Furthermore, the reverse of each sealed envelope should have the name and address of the bidder, project title and Lot No. and dropped in the designated Tender Box not later than 12:00 noon on Monday 2, December, 2019

8.0 OPENING OF EOI DOCUMENTS AND TECHNICAL BIDS
Category A & B: The technical bids will be opened immediately after the deadline for submission at 12:00 noon on Monday 13, January 2020, at the Conference Room on the 3rd Floor of the Ministry in the presence of bidders or their representatives, while the financial bids will be kept unopened.
Category C: EOI will be opened immediately after the deadline for submission at 12:00 noon Monday, 2, December, 2019 at the Conference Room on the 3rd Floor of the Ministry in the presence of bidders or their representatives. Only pre-qualified/shortlisted Consultants will be invited at a later date for collection of bid documents.

Note that the Ministry will not be held liable for misplaced or wrongly submitted Bids.

9.0 GENERAL INFORMATION
(a) Bids shall be in English Language and signed by an official authorised by the bidder.
(b) Bids submitted after the deadline for submission will be returned unopened.
( c) Bidders shall not bid for more than two (2) Lots.
( d) Details and specifications for each Lot is as contained in the Bid Documents.
( e) All costs will be borne by the bidders.
( f) Category A & B: Only technically qualified bidders will be contacted at a later date for financial bid opening, while financial bids of unsuccessful bidders will be returned unopened.
( g) Category C: Only shortlisted bidders will be contacted at a later date for collection of Request for Proposals
(h) The Federal Ministry of Health reserves the right to annul the process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act 2007.
(i) This advertisement shall not be construed as a commitment on the part of the Ministry nor shall it entitle tenderers to make any claims or seek any indemnity from the Ministry by virtue of his/her response to the Advert.
