INVITATION TO TENDER FOR 2019 APPROPRIATION PROJECTS

1. INTRODUCTION
1.1. The Federal Government of Nigeria has allocated funds from the 2019 Appropriation Act to the Federal Ministry of Transportation for the execution of policies, programmes and projects aimed at achieving its mandate.
1.2. Pursuant to the above and in line with the provisions of the Public Procurement Act 2007, the Ministry invites experienced and competent Contractors/Suppliers to submit bids for the following projects:

3. ELIGIBILITY REQUIREMENTS
I. Evidence of Certificate of Incorporation with the Corporate Affairs Commission (CAC) including for CAC2 and CAC7.
II. Evidence of Company’s current income Tax Clearance Certificate for the last three (3) years (2016, 2017 and 2018) valid till December 31st, 2019.
III. Evidence of Certificate of compliance from PENCOM in accordance with the Pension Reform Act 2004 valid till December 31st 2019.
IV. Evidence of Certificate of Compliance with contribution to Nigeria Social Insurance Trust Fund (NSITF) valid till December 31st 2019.
V. Evidence of Certificate of Compliance with Industrial Training Fund (ITF) valid till December 31st, 2019.
VI. Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31/1/2020 or valid Certificate issued by BPP.
VII. Accompany every bid with an affidavit disclosing whether or not any officer of the relevant committees of the Federal Ministry of Transportation or the Bureau of Public Procurement is a former or present Director, shareholder or has any pecuniary Interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars.
VIII. Reference Letter from a reputable commercial Bank indicating willingness to provide credit facility for the execution of the project when needed;
IX. Company’s Audited Account for the last three (3) years (2016, 2017 & 2018)
X. Verifiable documentary evidence of at least three (3) similar jobs executed in the last five (5) years including Letters of Award, Valuation Certificates, Job Completion Certificates and Photographs of the Projects;
XI. For Lot 2019-04, only companies included in the National Automotive Design and Development Council’s approved list of local manufacturers of vehicles or their authorized representatives should bid for the procurement.
XII. Consultancy Service: Evidence of registration with National Information Technology Development Agency (NITDA) and Computer Professionals Registration Council of Nigeria;
XIII. For Joint Venture/Partnership, Memorandum of Understanding (MoU) should be provided (CAC, Tax Clearance Certificate, Pension Compliance Certificate, ITF Compliance Certificate, NSITF Compliance Certificate, IRR & Sworn Affidavit are compulsory for each partner);
XIV. All documents for submission must be transmitted with a Covering/Forwarding letter under the Company/Firm’s Letter Head by the Corporate Affairs Commission (CAC), Contact Address, Telephone Number (preferably GSM No) and e-mail address. The Letterhead paper must bear the Names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorized officer of the firm.

4. COLLECTION OF TENDER DOCUMENTS
Interested companies should collect Tender Documents from the Office of the Director of Procurement, 6 Floor, Federal Ministry of Transportation, Bukar Dipcharima Building, Central Business District, Abuja, upon the presentation of evidence of payment of non-refundable tender fee of N10,000.00 paid into Federal Ministry of Transport-Hqtrs – 022900100100 Remita E-Collection account in any reputable commercial Bank in Nigeria.

5. SUBMISSION OF TENDER DOCUMENTS GOODS & WORKS:
Original and two (2) copies of the Technical and Financial bid are to be submitted in two separate envelopes. Envelopes for the Technical and Financial Proposals shall be duly marked “TECHNICAL BID” and “FINANCIAL BID” respectively. The two envelopes shall then be enclosed in one single outer envelope and forwarded in sealed envelopes, marked on the TOP left hand corner boldly written “PROJECT NAME AND LOT NUMBER” The inner and outer envelopes shall:
I. Bear the name and address of the Contractor, (inner envelope);
II. Be addressed to the Client at the address specified (inner and outer envelopes);
III. Bear the name of the project (inner and outer envelopes); and
IV. Bear a statement “Do not open with the technical proposal” (inner financial envelope).
The documents are to be dropped in the Tender Box in the Office of the Director of Procurement, 6th Floor, Federal Ministry of Transportation not later than 12:00 noon on Monday, 2nd December, 2019.

6. SUBMISSION OF EOI DOCUMENT (CONSULTANCY SERVICE)
Interested firms are to submit two (2) bound of Expression of Interest (Eol) documents separated by dividers and arranged as indicated above. The documents should be submitted in a sealed envelope and addressed as indicated above, and clearly marked with the name of the project and the Lot number).
Furthermore, the reverse of each sealed envelope should have the name and address of the bidder and drop in the designated Tender Box not later than 12:00 noon on 4th November, 2019.

7. OPENING OF EOI DOCUMENTS AND TECHNICAL BIDS
The EOI and technical bids will be opened immediately after the deadline for submission at 12:00 noon on 4th November, 2019 and 12:00 noon on Monday, 21st December, 2019, respectively, in the presence of bidders’ representatives at the Ground Floor, Tanning Hall of the Ministry and members of the public who choose to attend. Federal Ministry of Transportation will not be held liable for misplaced or wrongly submitted bids. For further enquiries, please contact: Office of the Director of Procurement, FMOT. 8. GENERAL INFORMATION
i. Bids must be in English Language and signed by an official authorised by the bidder;
ii. Bids submitted after deadline for submission would be returned un-opened;
iii. Bidders should not bid for more two (2) lots;
iv. All costs will be borne by the bidders;
v. All CAC, VAT, PENCOM, ITF, NSITF and Tax Clearance Certificate submitted shall be referred to security and other relevant Agencies for security and authentication.
vi. This invitation shall not be construed to be a commitment or obligation on the part of FMOT for award of any form of contract to any respondent nor shall it entitle any Company/firm submitting documents to claim any indemnity for the Ministry.
vii. The Ministry reserves the right to invoke the provisions of Section 28 of the Public Procurement Act (PPA) 2007, without incurring any liability to the bidder.
