INVITATION FOR PREQUALIFICATION/TECHNICAL BIDS/EXPRESSION OF INTEREST (EOI) FOR WORKS, GOODS AND SERVICES

1. INTRODUCTION
The federal ministry of works and housing intends to execute some project as contained in the 2020 Appropriation Act. in compliance with the provisions of the public procurement act, 2007 and other extant guidelines for the award of contract in the federal public service, the ministry wishes to invite experienced and competent contractors, suppliers and service providers to submit pre-qualification, technical and expression of interest (EOI) documents for the execution of the ministry’s project a contained in the 2020 Appropriation Act.

2. SCOPE OF WORK/ASSIGNMENTS
Details of the Scope of works/Specifications and Assignments are contained in the bid documents. The project are grouped into categories A to E. Bidders are, therefore, required t submit Pre-qualification, Technical, and expression of Interest document in respect of the categories chosen on the basis of the requirements listed in Section 3.0, 40. and 8.0. of this publication. The project is listed in the table below:

3. ELIGIBILITY REQUIREMENTS
The Ministry, in compliance with the provisions of the Public procurement Act, 2007 and he Public procurement regulation for works, Goods and Services, will carry out pre-qualification/shortlisting of companies/consultants that respond to this advertisement based on the following requirements:
a. Evidence of certificate of Incorporation issued by Corporate Affairs Commission (CAC0 including Forms CAC2 and CAC7
b. Evidence of company Current Annual returns to CAC for categories A, B & C;
c. Evidence of Tax Clearance Certificate (TCC) for the last three (3) years (2017, 2018, 2019) valid till 31st December, 2020;
d. Evidence of current pension Compliance certificate valid till 31st December 2020;
e. Evidence of current Industrial training Fund (ITF) Compliance Certificate valid till 31st December, 2020
f. Evidence of current Nigeria Social Insurance Trust Fund (NSITF) compliance certificate valid till 31st December 2020
g. Evidence of registration on the BPP’s National database of Federal Contractors, consultants and services providers by submission of a valid certificate of registration or interim Registration report (IRR) expiring on 31/01/2021
h. Unabridged Company Audited annual report for the immediate past three (3) years (2017, 2018, 20190
i. For Joint Venture/Partnership, Memorandum of Understanding (MoU) should be provided (CAC, TCC, Pension Compliance Certificate, ITF Compliance Certificate, NSITF Compliance certificate, IRR & Sworn Affidavit are compulsory for each JV Partner)
j. A sworn Affidavit
– Disclosing whether or not any officer of the relevant committees of the Federal Ministry of Works and Housing or the Bureau of Public Procurement is a former of present Director, Shareholder or has any pecuniary interest in the bidders and to confirm that all information presented in its bid are true and correct in all particulars;
– That no Partner/Director has been convicted in any country for critical offences related to fraudulent or corrupt practices, or criminal misrepresentation or falsification of facts relating to any matter;
– That the company does not at any the time of his bid have any existing loan or financial liability with a bank, other financial institutions or third party that is classified as doubtful, non-performing, bad or whose repayment portion has been outstanding for the last three months.
k. Evidence of Particulars of Directors;

3.1. LOCAL CONTENT, SAFETY AND SOCIAL RESPONSIBILITY FOR CATEGORIES A & B
i. Indicate the Quantum of Verifiable Employments to be generated stating projected numbers and specialties for Skilled (Professional) and Unskilled (Non-professional) Manpower
ii. Submit verifiable key Management positions that are Nigerian Nationals and the percentage of the company’s total workforce that will be beneficial to youth employment and community development in Nigeria
iii. All bidders should include description of current Health, Safety and environment 9HSE) procedures, plan, manuals and HSE performance statistics over the last 3 years including HSE manuals and accident statistics for the past five (5) years ; and
iv. Submit a plan on how to give first consideration to service provided from within Nigeria, raw materials and manufactured goods of Nigeria origin in line with the requirements of Nigerian Content.
V. State proposed social benefit to be accrued to the host communities where projects/services are domiciled.

4. SPECIFIC REQUIREMENT FOR EVALUATION
In addition to the requirement stipulated in 3.1 to 3.2 bidders are to fulfill the under listed requirements:
4.1. CATEGORY A: ROADS & BRIDGES
A. Annual Turnover
Bidders must have average annual turnover of ten (10) Billion naira (as evidenced in the tax clearance certificate) in the last three (3) years (2017, 2018, 2019)

B. Bidders Experience
Bidders must be prime contractor on at least two (2) projects of similar nature, Magnitude and complexity comparable t the works under consideration within the last five (5) years (copies of letters of award/certificate of completion to be attached)

C. Plant and Equipment
Verifiable evidence that the Bidders have the requisite plants and equipment to execute project of the nature and complexity including Asphalt and Quarry Pants in the Geopolitical Zone of the project bided for.

D. Financial capacity
Evidence if access to or availability of credit facilities, confirmed by a reputable bank, equivalent of one (1) billion Naira net of other contracted commitments of the successful bidders shall be required;

E. Manpower
Company profiles with CVs of key professional including photocopies of relevant academic and professional qualifications with attestation of availability an contact phone numbers (evidence of registration with relevant regulatory professional bodies e.g. COREN, ARCON, CORBON,QSRBN);

F. Evidence of Firm’s registration with relevant professional body such as: COREN/QSRBN/ARCON/CORBON/SURCON etc.

G. Maximum Number of Lots
Bidders must restrict their submission of bids to a minimum of one (1) lot, in this category, located in a geopolitical Zones where they are already mobilized, and which they have comparative advantage in terms of logistics and communities social relations.

4.2. CATEGORY B: ROADS AND BRIDGES
A. Annual Turnover
Average Annual Turnover of Two Hundred and Fifty Million Naira (N250, 000,000.00) (as evidenced in tax clearance certficate0 in the last three (3) years (2017, 2018, & 2019),

B. Bidders Experience
Experience as a prime contractor on at least two (2) projects of similar nature and complexity comparable to the woks under consideration within the last five (5) years (Copies of letter of award/certificate of completion to be attached);

C. Plant and Equipment
Evidence that the Bidders have the requisite plants and equipment to execute project of this nature and complexity;

D. Financial Capacity
Evidence of access to or availability of credit facilities, certified by a reputable Bankers, equivalent of Fifty Million Naira (N50, 000,000.00) net of other contracted commitments of the successful bidders shall be required;

E. Manpower
Company profiles with CVs of key professional including photocopies of relevant academic and professional qualifications with attestation of availability an contact phone numbers (evidence of registration with relevant regulatory professional bodies e.g. COREN, ARCON, CORBON,QSRBN);

F. This is exclusive to Nigeria Firms;

G. Maximum Number of Lots
Bidders must restrict their submission of bids to a minimum of one (1) lot, in this category, located in a geopolitical Zones where they are already mobilized, and which they have comparative advantage in terms of logistics and communities social relations;

4.3. TECHNICAL REQUIREMENTS FOR BRIDGES
In addition to the requirements in 4.3, applicants must be specialist in Bridge construction/Rehabilitation and shall have the following Minimum Criteria:
a. Evidence of experience related to the Project’s scope of work which must be described in detail, namely changing of Expansion Joints, Concert Strengthen, Changing of Pot Bearings, Post Tensioning works, Concrete Skin, Repair, Pavement Rehabilitation, Corrosion protection Measures, etc.
b. Submit Method statements and provide Repair techniques related to concrete Repair Works which must comply with other refurbishment works of the Bridge.
c. Applicant must have been engaged in active business a s concrete Repair Works and Bridge Rehabilitation Contractor for a minimum of two Jobs under the name of the firm applying for pre-qualification, and must provide Award Letters as evidence
d. Applicants nus provide all information pertaining to the Experience of the Firm and to its specialist engineers in similar type of works (Provide CVs)
e. Evidence of having access to specialized Bridge repair Material and bridge Components’ manufacturers and Suppliers
f. Capability for batching, controlling, placing finishing and curing concrete with Sepcialized Materials for the resurfacing of the Burnt Section of the Bridge Deck
g. Evidence of having a Local experience in the same type of Works within the last few years is an advantage
4.4. CATEGORY C, D AND E: OTHER WORKS, GOODS AND SERVICES
A. Bidders’ Experience
Evidence of previous similar jobs with two (2) letters of award in the last three (3) years (2017, 2018, 2019)

B. Plant and equipment/warehouse
Verifiable evidence of proof of ownership and/or lease of the construction equipment/Warehouse required for the successful execution of these contracts especially category C & D;

C. Financial Capacity
Evidence of financial Capability by submission of letter of reference from a reputable commercial Bank in Nigeria, Indicating Commitment to fund the project when awarded;

D. Registration with Professional Bodies
Evidence of registration with relevant professional body e.g. NAICOM/Insurance, EHORECON/leaning Service, NITDA/CPN/Information technology, COREN/QSRBN/ARCON/CORBON/SURCON/Construction, NSCDC/Security, ESVARBON/Estate Surveying etc.

E. Manpower
Key personnel with evidence of registration with Professional Bodies like COREN, QSRBN, ARCON, SURCON, CORBON, TOPREC, NIESV, CIPSMN etc.;
F. Note that indigenous companies have an advantage in these categories.

6.0. METHODS OF SUBMISSION
i. Bides must be prepared in English Language and signed by the official authorized by the bidders
ii. Two copies of Technical Documents/Expression of Interest (EOI) for all categories must be submitted on or before 12:00 noon on Monday, …… 2020. Late submissions will be returned un-opened.
iii. Bids for categories A & B are to be submitted at the Procurement department Room 105, Block A, 1st Floor, works Sector FMW&H Mabuchi, Abuja.
iv. Bids for categories C, D and E are to be submitted at the Conference Room, 3rd Floor, Housing Block, FMW&H, Mabushi, Abuja

7.0. OPENING OF EOI/BIDS
i. EOI/Technical Bid Document will be opened immediately after the deadline for submission at 12:00 noon on Monday, ……….. 2020, at the venue stated in 6(iii) and (iv) above
ii. Only technically shortlisted bidders will be invited for collation of financial bids and request for Proposal;
Companies or their representative, Civil Societies, NGOs, Professional Bodies and members of the public are by this notice, invited to witness the bids opening exercise

8.0. ADDITIONAL INFORMATION
Subject to the Provision of the Public Procurement Act, 2007 note that:
i. The Ministry may verify any or all the claims made by applicant and shall disqualify any company whose claims are found to be false in addition to other sanctions that may be deemed necessary.
ii. Bidders who and worked for the Ministry and have history of poor performance, abandonment, termination and/or prolonged contract execution period need to apply as their bids may be excluded from the process in line with section 16(8) (b) of the PPA, 2007
iii. The Ministry reserve the right to reject any and/or all prequalified Bidders at his sole discretion and at no cost whatsoever in line with the Section 28 of the PPA, 2007
iv. All cost incurred in responding to this advent and prequalifying for the project shall be borne solely by the Bidders;
v. For Bidders of the project in the Niger Delta Area and the North Eastern Geopolitical Zone it is required that they present a formal undertaking that they are capable of working in the area.
vi. None compliance to any of the above instruction will lead to disqualification; and
vii. This advertising shall not be construed as a commitment on the part of the Ministry to award contract to any bidders
viii. All document for submission must be transmitted with a Covering/Forwarding letter under the Company/First Letter Head Paper bearing amongst others, the Registration number (RC) as issued by the Corporate Affairs Commission (CAC), contact Address, Telephone Number (Preferably GSM No.) , and e-mail address. The Letter head paper must bear the Names and notifications of the Directors of the company at the bottom of the page, duly signed by the authorized officer of the firm.
