INVITATION TO TENDER/PREQUALIFICATION/EXPRESSION OF INTERESTS FOR PROJECTS EXECUTION

1.0 INTRODUCTION
The Federal Government of Nigeria has allocated funds to the Rural Electrification
Agency (REA) under the 2024 Appropriation Act to carry out Electrification
projects. In compliance with the provision of the Public Procurement Act 2007, the
Agency hereby invites competent and experienced Nigerian contractors to submit tenders, Pre-qualification and Expression of Interest Documents for the electrification projects listed below:

2.0 SCOPE OF WORKS

3.0 ELIGIBILITY CRITERIA
Prospective bidders are required to submit genuine copies of the following documents as proof of their technical eligibility:
a. Evidence of Certificate of Incorporation issued by the Corporate Affairs Commission (CAC) including Form CAC1.1 or CAC2 and CAC7. Business Name with Form BN1 is also acceptable for Consultancy Services:
b. Evidence of Company’s Income Tax Clearance Certificate (or Personal Income Tax Clearance Certificates of all the Partners in case of Business Name) for the last three (3) years valid till 31st December, 2024;
c. Evidence of Pension Clearance Certificate valid till 31st December, 2024 (this requirement is only applicable to bidders whose number of staff is 15 and above):
d. Evidence of Industrial Training Fund (ITF) Compliance Certificate valid till 31st December, 2024 (this requirement is only applicable to bidders whose number of staff is 5 and above or the bidder’s annual turnover is N50m and above):
e. Evidence of Nigeria Social Insurance Trust Fund (NSITF) Clearance Certificate valid till 31st December, 2024;
f. Evidence of Registration on the National Database of Federal Contractors, Consultants and Service Providers by submission of Interim Registration Report (IRR) expiring on 31/12/2024 or valid Certificate issued by BPP.
g. Sworn Affidavit:

• disclosing whether or not any officer of the relevant committees of the Rural Electrification Agency or the Bureau of Public Procurement is a former or present Director, shareholder or has any pecuniary interest in the bidder and to confirm that all information presented in its bid are true and correct in all particulars;
• that no Director has been convicted in any Country for any criminal offence relating to fraud or financial impropriety or criminal misrepresentation or falsification of facts relating to any matter;
• that the Company is not in receivership, the subject of any form of insolvency or bankruptcy proceedings or the subject of any form of winding up petition or proceedings:

h. Company’s Audited Accounts for the last three (3) years-2021, 2022 & 2023;
i. Reference Letter from a reputable Commercial Bank in Nigeria, indicating willingness to provide credit facility for the execution of the project when needed;
j. Company’s Profile with the Curriculum Vitae of Key Staff to be deployed for the project, including copies of their Academic/Professional qualifications such as COREN, QSRBN, ARCON, CORBON, etc.:
k. Electricity Jobs: Evidence of current Licence issued by Nigerian Electricity Management Services Agency (NEMSA):
l. For Supply of Equipment: Letter of Authorisation as representative of the Original Equipment Manufacturers (OEMs);
m. Only Companies included in the National Automotive Design and Development Council’s approved list of local manufacturers of vehicles or their authorised representatives should bid for the Vehicles;
n. Verifiable documentary evidence of at least three (3) similar jobs (in size, nature & complexity) executed in the last five (5) years including Letters of Awards, Valuation Certificates, Job Completion Certificates and Photographs of the projects:
o. Duly executed Power of Attorney or Board Resolution authorizing a designated officer of the Company to act as a representative and to bind the company by signing all bids, Contract Agreement and other documents with REA on behalf of the company, duly signed by the Chairman and Secretary of the Board of Directors
p. List of Plants/Equipment with proof of Ownership/Lease Agreement;
Consultancy Services:
q. Evidence of Firm’s current registration with the relevant regulatory professional body(ies)
r. For Joint Venture/Partnership, Memorandum of Understanding (MOU) indicating Lead Partner should be provided (CAC, Tax Clearance Certificate, Pension Clearance Certificate, ITF Compliance Certificate, NSITF Clearance Certificate, IRR & Sworn Affidavit are compulsory for each JV partner)

Note: All documents for submission must be transmitted with a Covering/Forwarding letter under the Company/Firm’s Letter Head Paper bearing amongst others, the Registration Number (RC) as issued by the Corporate Affairs Commission (CAC). Contact Address, Telephone Number (preferably GSM No.), and e-mail address. The Letterhead Paper must bear the Names and Nationalities of the Directors of the Company at the bottom of the page, duly signed by the authorised officer of the firm.

4. COLLECTION OF TENDER DOCUMENTS
Interested companies are to collect the Standard Bidding Document (SBD) from the office of the Procurement Directorate, REA Corporate Headquarters, 22 Free Town Street, Wuse 2, Abuja on evidence of payment of a non-refundable tender fee of N10,000.00 per Lot, paid into the National Rural Electrification Agency (NREA) remita account in any reputable commercial bank in Nigeria AND NOT Nigeria Electricity Project (NEP) using GIFMIS CODE 1000024043 after which bidders should proceed to REA Finance and Account Department with their RRR to obtain Receipt of payment. Collection of Documents shall be between the hours of 10:00am and 4:00pm Monday to Friday

5. SUBMISSION OF TENDER DOCUMENTS (CATEGORIES A,B,C & E)
Prospective bidders are to submit bid for each of the Lot desired, two (2) hard copies each of the technical and financial bids with softcopy of financial bid only in MS Excel format, packaged separately in sealed envelopes and clearly marked as “Technical Bid” or “Financial Bid”. Thereafter, put the two sealed envelopes together in a bigger sealed envelope addressed to The Managing Director/CEO Rural Electrification Agency Corporate Headquarters 22, Freetown Street Wuse 2, Abuja and clearly marked with the name of the project and the Lot number. Furthermore, the reverse of each sealed envelope should bear the name and address of the bidder and drop in the designated Tender Box designated points within the Agency’s Corporate Headquarters, 22 Freetown Street, Wuse 2, Abuja not later than 12:00 noon on Monday, 19th August, 2024.

6. SUBMISSION OF EOI (CATEGORY G, CONSULTANCY SERVICES)
Interested firms are to submit two (2) bound of Expression of Interest (Eol) documents separated by dividers and arranged as indicated above. The documents should be submitted in a sealed envelope and addressed to The Managing Director/CEO Rural Electrification Agency Corporate Headquarters 22, Freetown Street Wuse 2, Abuja and clearly marked with the name of the project and the Lot number. Furthermore, the reverse of each sealed envelope should bear the name and address of the bidder and drop in the designated Tender Box at designated points within the Agency’s Corporate Headquarters, 22 Freetown Street, Wuse 2, Abuja not later than 12:00 noon on Monday 5th August, 2024.

7. SUBMISSION OF PREQUALIFICATION DOCUMENTS (CATEGORY D)
Prospective bidders are to submit pre-qualification documents for each of the Lot desired; two (2) hard copies each of the technical bids packaged in sealed envelopes and clearly marked as “Technical Bid”; and addressed to The Managing Director/CEO Rural Electrification Agency Corporate Headquarters 22, Freetown Street Wuse 2, Abuja and clearly marked with the name of the project and the Lot number. Furthermore, the reverse of each sealed envelope should have the name and address of the bidder and drop in the designated Tender Box at designated points within the Agency’s Corporate Headquarters, 22 Freetown Street, Wuse 2, Abuja not later than 12:00 noon on Monday 5th August, 2024.

8. OPENING OF EOI/PREQUALIFICATION AND TENDER DOCUMENTS
The Technical bids for categories (A, B C and E) shall be opened immediately after close of submissions at 12:00 Noon on Monday, 19th August, 2024. The public opening shall take place at REA Corporate Headquarters, 22 Freetown Street, Wuse 2, Abuja in the presence of bidders, or their representatives and observers from invited professional Bodies and civil Society Organizations while that of Categories D and G would take place by 12:00 noon on Monday, 5th August, 2024. Bidders should ensure that they sign the Bid Submission Register and obtain Bid Acknowledgment Receipt before dropping their bids in the Tender Boxes as REA will not be held responsible for lost, misplaced or wrongly submitted bids.

9. GENERAL INFORMATION
a. EOI/Bids and prequalification documents must be in English Language and signed by an official authorised by the Applicant:
b. Eol/Bids and prequalification documents submitted after the deadline for submission would be returned un-opened;
c. Applicants should not bid for more than two (2) Lots; which must be selected from different project categories. Any bidder discovered to have submitted bid for more than one (1) lot in the same category or for more than two (2) lots in total shall be disqualified;
d. All costs will be bome by the bidders:
e. The EOI/prequalification documents and Technical Bids will be opened in the presence of Bidders or their representatives, CSOs in the areas of Anti- Corruption and Transparency and Private Professional bodies; and will be covered by video recording; invitation link will be sent to bidder who chooses to join the bid opening online:
f. Categories A, B, C and E: Only pre-qualified bidders at technical evaluation will be invited at a later date for financial bids opening, while the financial bids of un-successful bidders will be returned un-opened;
g. Category D: Only pre-qualified bidders will be invited at a later date for collection of tender documents;
h. Category G: Only shortlisted firms will be invited at a later date for collection of Request for Proposals;
i. This advertisement is published only for information purposes and does not constitute an offer, commitment or obligation by REA to transact with any party nor entitle any contractor to make any claims, whatsoever or seek any indemnity from the Agency.
j. The Rural Electrification Agency is not bound to pre-qualify/shortlist any Applicant and reserves the right to annul the Procurement process at any time without incurring any liabilities in accordance with Section 28 of the Public Procurement Act, 2007.
